This Privacy Policy describes how Hero Schedule LLC ("Company," "we," "us," "our") collects, uses, and shares your personal information when you visit heroschedule.com and/or shiftbid.co (the "Site") or use the Hero Schedule mobile application (the "App") (collectively, the "Services").

INFORMATION WE COLLECT

Information You Provide to Us

When you register for an account or use the Services, we collect information you provide directly, including:

  • Name, email address, and phone number
  • Employee identification number (for registered users)
  • Work schedule and shift data
  • Payment information (credit card numbers, billing information) for subscription purchases
  • Any other information you choose to provide

When you submit a contact form through the Site, we collect your name, email address, and phone number to respond to your inquiry.

Information We Collect Automatically

When you visit the Site or use the App, we automatically collect certain information about your device and usage, including:

  • IP address, browser type, and operating system
  • Device identifiers and mobile device information
  • Time zone and language settings
  • Pages viewed, features used, and how you interact with the Services
  • Referring URLs and search terms that directed you to the Site
  • Date and time stamps of activity

We collect this information using the following technologies:

Third-Party Services We Use

We use third-party services that may collect or process information in connection with your use of the Services. These providers are listed below, organized by where they operate.

Website only (heroschedule.com and shiftbid.co):

App and Website:

  • Mailgun — used to deliver transactional emails including account notifications, invoices, and schedule alerts. Mailgun's privacy policy is available at https://www.mailgun.com/privacy-policy/.

App only:

  • PostHog — used to analyze how users interact with the App, including which features are used and how users navigate the interface. PostHog's privacy policy is available at https://posthog.com/privacy.
  • Sinch — used to deliver SMS text message notifications to users who have opted in to receive schedule alerts and updates. Sinch's privacy policy is available at https://www.sinch.com/privacy-policy/.

We are responsible for ensuring that any third-party service we integrate with handles your data in a manner consistent with this Privacy Policy.

HOW WE USE YOUR INFORMATION

We use the information we collect to:

  • Provide, maintain, and improve the Services
  • Process subscription payments and send invoices and order confirmations
  • Manage user accounts, schedules, shift requests, and related workflows
  • Send schedule notifications, alerts, and shift updates via text and email
  • Respond to your questions and support requests
  • Screen for potential risk or fraud
  • Analyze usage patterns to improve the Services
  • Send you information about our products and services, where permitted
  • Comply with applicable legal obligations

HOW WE SHARE YOUR INFORMATION

We share your personal information only in the following circumstances:

  • Service providers — We share information with third-party vendors who help us operate the Services (such as payment processors, hosting providers, email delivery, SMS delivery, and analytics tools). These providers are contractually required to protect your information and may not use it for their own purposes.
  • Your organization — If you use the Services through your employer or agency, authorized administrators within your organization may have access to your account information, schedule data, and activity within the platform.
  • Legal requirements — We may disclose your information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request, or to protect our rights or the rights of others.
  • Business transfers — In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a different privacy policy.

Mobile Information Sharing Exclusion: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties.

We do not sell your personal information.

TEXT MESSAGING

The Services include optional text message notifications for schedule changes, open shifts, and other alerts. By providing your phone number and opting in to text notifications, you consent to receive these messages.

  • Message frequency varies based on your schedule activity.
  • Message and data rates may apply.
  • To opt out, reply STOP to any message.
  • To request help, reply HELP.

BEHAVIORAL ADVERTISING

We may use your information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. You can opt out of targeted advertising from:

We do not alter our data collection or use practices in response to a Do Not Track signal from your browser.

YOUR RIGHTS AND CHOICES

You have the following rights regarding your personal information:

  • Access — You may request a copy of the personal information we hold about you.
  • Correction — You may request that we correct inaccurate or incomplete information.
  • Deletion — You may request that we delete your personal information. You may initiate account deletion directly through the App by navigating to Settings and selecting "Delete Account," or by contacting us at contactus@heroschedule.com with the subject line "Data Deletion Request." We will process your request within 30 days. Note that we may retain certain information as required by law or for legitimate business purposes (such as billing records).
  • Opt-out of marketing — You may opt out of receiving marketing communications from us at any time by following the unsubscribe instructions in those communications or by contacting us directly.

If you use the Services through your employer or agency, please note that your organization may also have separate rights and responsibilities regarding your data as a data controller. Contact your administrator for more information.

DATA RETENTION

We retain your personal information for as long as your account is active or as needed to provide the Services. We also retain information as necessary to comply with legal obligations, resolve disputes, and enforce our agreements. If you request deletion of your account, we will delete or anonymize your personal information within 30 days, except where retention is required by law.

Account subscription and billing records may be retained for up to seven (7) years in accordance with standard accounting and legal requirements.

DATA SECURITY

We implement commercially reasonable technical and organizational measures to protect your personal information against unauthorized access, loss, or misuse. All data transmitted through the Services is protected using TLS encryption. Data is stored on U.S.-based servers with point-in-time backup capabilities.

No method of transmission over the Internet or electronic storage is completely secure. While we strive to protect your personal information, we cannot guarantee absolute security.

MOBILE APPLICATION

The Hero Schedule mobile application is available as a Progressive Web App (PWA) and on the Apple App Store and Google Play. When you use the App, we collect the same categories of information described in this Privacy Policy. The App does not collect any data that is not described above.

MINORS

The Services are not intended for individuals under the age of 18. We do not knowingly collect personal information from anyone under 18. If you believe we have inadvertently collected information from a minor, please contact us immediately and we will delete it.

CALIFORNIA RESIDENTS

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, the right to request deletion, and the right to opt out of the sale of personal information. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time to reflect changes to our practices or for legal, operational, or regulatory reasons. When we make material changes, we will update the "Last updated" date at the top of this page and notify registered users via email or an in-app notice. Your continued use of the Services after any changes constitutes your acceptance of the updated Privacy Policy.
